Welcome to WH³ (“What Had Happened Here?”). By downloading, accessing, or using our mobile application, you agree to be bound by these Terms of Service. Please read them carefully.

1. Acceptance of Terms

By accessing or using WH³, you agree to these Terms of Service and our Privacy Policy. If you do not agree to these terms, do not use the app.

2. Description of Service

WH³ is a mobile application that provides AI-generated historical information about locations in the United States. The app uses your device's location to deliver content about what happened at your current position, on your street, and in your neighborhood.

3. Account Registration

To use WH³, you must create an account using Apple Sign-In. You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account.

You agree to:

  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized use of your account
  • Accept responsibility for all activities under your account

4. Subscription and Payments

WH³ offers a subscription service at $4.99 per month. Your first lookup is completely free.

  • Billing: Subscriptions are billed monthly through the Apple App Store.
  • Auto-Renewal: Your subscription will automatically renew unless canceled at least 24 hours before the end of the current billing period.
  • Cancellation: You may cancel your subscription at any time through your Apple ID account settings.
  • Refunds: Refunds are handled according to Apple's refund policies.

5. Location Services

WH³ requires access to your device's location services to function. By using the app, you consent to the collection and use of your precise location data as described in our Privacy Policy.

You may revoke location permissions at any time through your device settings, but this will prevent the app from providing its core functionality.

6. Content and Accuracy

The historical content provided by WH³ is generated using artificial intelligence and is intended for educational and entertainment purposes.

  • No Guarantee of Accuracy: While we strive to provide accurate historical information, we cannot guarantee the accuracy, completeness, or reliability of AI-generated content.
  • Not Professional Advice: Content should not be relied upon as professional historical research or academic source material.
  • User Discretion: Users should verify important historical claims through authoritative sources.

7. Acceptable Use

You agree not to:

  • Use the service for any unlawful purpose or in violation of these terms
  • Attempt to gain unauthorized access to our systems or user accounts
  • Interfere with or disrupt the service or servers connected to the service
  • Use automated means to access the service without our permission
  • Reproduce, distribute, or create derivative works from our content without permission
  • Use the service in any way that could damage our reputation or goodwill

8. Intellectual Property

All content, features, and functionality of WH³, including but not limited to text, graphics, logos, and software, are owned by WH³ or its licensors and are protected by intellectual property laws.

Content saved to your Journey is for your personal, non-commercial use only.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the service will be uninterrupted, secure, or error-free, or that any defects will be corrected.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WH³ AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY.

Our total liability for any claims arising from or related to the service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

11. Termination

We may terminate or suspend your account and access to the service at our sole discretion, without prior notice, for conduct that we believe violates these Terms of Service or is harmful to other users, us, or third parties, or for any other reason.

You may terminate your account at any time by deleting your account through the app settings.

12. Changes to Terms

We reserve the right to modify these Terms of Service at any time. We will notify you of any material changes by posting the new terms in the app or on our website. Your continued use of the service after changes are posted constitutes acceptance of the modified terms.

13. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
